TERMS & CONDITIONS ADDENDUM
This Byline Bank Debit Card Controls & Alerts Terms & Conditions Addendum (“Terms and Conditions” or “Addendum“) is provided to you by Byline Bank and governs your use of our Debit Card Controls & Alerts service in connection with Byline Bank issued Mastercard Debit Card(s) (“Card Controls & Alerts,” or “the Service”). This Addendum is part of, and is subject to the terms of the Byline Bank Digital Banking Terms & Conditions and/or the Byline Bank Business Digital Banking & Treasury Management Master Services Agreement (each individually and collectively, the “Digital Banking Agreement”). Capitalized terms not defined in this Addendum have the meanings provided in the Digital Banking Agreement. In the event of a conflict between the terms of this Addendum and the terms of the applicable Digital Banking Agreement, the terms of this Addendum shall control for purposes of this Addendum and Card Controls & Alerts only.

PLEASE CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE COMPLETING YOUR ENROLLMENT IN CARD CONTROLS & ALERTS. BY ENROLLING IN CARD CONTROLS & ALERTS, YOU ARE: (1) REQUESTING THE CARD ALERTS (“ALERTS”) AND CARD TRANSACTION CONTROLS (“CONTROLS”) DESIGNATED BY YOU; (2) CONSENTING TO RECEIVE THE ALERTS TO THE MOBILE PHONE NUMBER(S) VIA SMS TEXT (“TEXT”) MESSAGES AND/OR EMAIL ADDRESS(ES) DESIGNATED BY YOU; AND (3) AGREEING TO BE BOUND BY THESE TERMS AND CONDITIONS WITH RESPECT TO YOUR USE OF CARD CONTROLS AND ALERTS.
I. Definitions. In addition to those terms defined throughout this Addendum, the following terms when used in this Addendum shall have the following meaning:
“You” or “your” means the Byline Bank Mastercard Debit Card Cardholders who enrolled in the Service;
“Card” means your Bank issued Mastercard Debit Card(s);
II. Eligibility. To use the Service, you must: (1) have a Card and an Account to which the Card is linked that are in good standing; (2) be enrolled in Digital Banking; (3) enroll in Controls and/or Alerts in the Card Management section of Digital Banking; (4) have a permanent U.S. mobile phone number assigned by a U.S. wireless carrier to a mobile plan for you; and, a compatible Mobile Device, or a valid email address. The Service can be used abroad in countries with compatible mobile networks subject to Applicable Law, though mobile phone charges may be higher. You are responsible for ensuring that your use of the Service does not breach any other agreements to which you are a party, such as with your wireless carrier.
III. Service Description. With Card Controls & Alerts, you may:
- Request transaction Alerts by dollar amount, transaction type or merchant type, and/or other categories determined by us;
- Set a transaction to decline if it meets one of the following criteria, or other criteria as described in the Service:
- Transaction amount is over a specified amount
- Transaction Type (the transaction type is set by the merchant and Mastercard)
- Merchant type
Your mobile phone number, email address, and the types of Alerts that you wish to receive and Controls you wish to set must be designated by you after you register a Card. You may change those designations by going to the Manage Cards section within “Services” in Digital Banking (“Manage Cards Section”). The Service will send you the Alerts that you selected to the mobile phone number via Text messages and/or to the email address you have designated.
The Service does not allow for the cancellation of authorized or pre-authorized Card transactions. It is not intended as a method for stopping payment on authorized or pre-authorized Card transactions. To stop payment on authorized and pre-authorized Card transactions, please contact the merchant, or contact us at (773) 244-7000.
IV. Consent to Emails and Automated Text Messages. By providing us with a mobile phone number and/or email address and enrolling in Card Controls & Alerts, you represent that you are the owner of the email address and/or mobile phone number you registered, or that you have the delegated legal authority to act on behalf of the owner of such email address or mobile phone number to use it in connection with Card Controls & Alerts. If your email address or your mobile phone number changes, you are responsible for immediately informing us by updating your information in the Managed Card Section of Digital Banking or calling us at (773) 244-7000. You, for yourself and on behalf of any owner of an email address or mobile phone number enrolled in Card Controls & Alerts, consent to the receipt of email and/or Text messages (including through use of an automatic dialer) from us, our agents and service providers. Alerts may be delivered at any time of the day or night and you specifically consent to receive such Alerts between the hours of 9 pm and 8 am your local time.
To cancel Alert Text messages from us regarding Card Controls, send STOP to 86434. You expressly consent to receipt of a text message to confirm your “STOP” request. You may also log in to Digital Banking and change your Alert designations or delivery method or you may contact us at (773) 244-7000. Further, you agree that in the event you cancel the receipt of autodialed text messages from us relating to CARD CONTROLS & ALERTS, such cancellation applies to the receipt of autodialed text messages relating to CARD CONTROLS & alerts, text banking, secure access codes, and security and service alerts that we may provide to you. Such cancellation does not apply to any consent to receive autodialed text messages you provided or will provide to Byline Bank in connection with any current or future accounts, products and/or other services. If you want to opt out of receiving other Text messages, please call us at (773) 244-7000.
V. Fees. We do not charge a Service Fee to use Card Controls & Alerts. You are responsible for any fees or other charges that your wireless carrier may charge for any related data, Text or other message services, including without limitation for short message service. Please check your mobile service agreement for details or applicable fees.
VI. Alerts. If you registered to receive Alerts to your mobile phone number, the actual time between a transaction made with your Card that triggers an Alert and the time the Alert is sent to your mobile phone number is dependent on your wireless service and coverage within the area in which you are located at that time. Alerts may not be available to be sent to your mobile phone number(s) in all geographic areas.
VII. Changing your Alert Message Delivery Channel. To change your Alert message delivery channel, go to the Alerts page within the Managed Card Section in Digital Banking and uncheck the box for email if you want to discontinue receiving Alerts by email and uncheck the box for SMS message if you want to discontinue receiving Alerts by Text message. The change will discontinue the channel for all Cards registered in Card Controls & Alerts.
VIII. Cancelling the Service. To cancel the Service and discontinue Card Controls & Alerts, complete the following: To cancel Card Controls, uncheck all enabled Control selections and click “Submit limits” within Card Controls. In order to no longer receive Alerts, uncheck all enabled Alert options and click “Submit alerts” within Alerts. A delivery option is still required to submit the request. You may also opt-out of having Alerts sent to your mobile phone number; see the Consent to Automated Text Messages Section above for information.
IX. Availability/Interruption/Delivery Failure. The Service is generally available when you have your Mobile Device within operating range of a carrier with an appropriate signal for data services.
You understand and agree that your Alerts may be delayed or prevented by a variety of factors. We neither guarantee the delivery nor the accuracy of the content of any Alert or that Card Controls & Alerts will be available at all times or in all areas. You also agree that we shall not be liable for any delays, failure to deliver, or misdirected delivery of any Alert; for any errors in the content of an Alert; or for any actions taken or not taken by you or any third party in reliance of an Alert or if a transaction is not declined when a Control is set. Because Alerts are not encrypted, we will never include your Password or full Account number. However, depending upon which Alerts you select, Alerts may include your name and some information about your Accounts. Alerts may be delivered at any time of the day or night and you specifically consent to receive such Alerts between the hours of 9 pm and 8 am your local time.
IX. Content Restrictions. You agree that you will not use Card Control & Alerts for any unlawful or inappropriate purposes, such as gambling, obscenity, pornography, violence, misappropriation, unauthorized access or interference, viruses or harmful code, harassment, unsolicited or deceptive messages, or any other activity that could diminish or harm the reputation of the Bank or any of its service providers involved in providing Card Control & Alerts.
XI. Governing Agreements. Card Controls & Alerts and these Terms and Conditions do not amend the Byline Debit Card Agreement governing your Card(s) that you registered with the Service. The Alerts that are sent to you through the Service do not amend, supplement, change or replace these Terms and Conditions, or the terms, conditions and disclosures in your Byline Bank Debit Card Agreement, the applicable Digital Banking Agreement, the applicable Deposit Account Agreement, your periodic statements, and/or other applicable agreements and disclosures or any other notice or information that you may receive in connection with your Card(s) or Account(s).
